GENERAL TERMS AND CONDITIONS / TERMS OF SERVICE

Effective date: 11 August 2026

These General Terms and Conditions (“Terms”) govern the use of the Monautix online store and purchases made through it.

By placing an order through the online store, the Customer acknowledges that these Terms and the policies referred to in them have been made available before the order is submitted.

Nothing in these Terms excludes, restricts or replaces any right or remedy that cannot lawfully be excluded, restricted or replaced under applicable Hungarian or European Union law.

Monautix Kft. is hereinafter referred to as “Monautix”, “we”, “us” or “our”.

2. SCOPE AND DEFINITIONS

These Terms apply to the use of the Monautix online store and to contracts concluded through the online store between Monautix and its Customers.

A Consumer means a natural person acting for purposes outside their trade, business, craft or profession.

A Business Customer means a person or entity purchasing in connection with its trade, business, profession or commercial activity.

Where mandatory Hungarian law grants particular consumer-type rights to micro, small or medium-sized enterprises or to other entities, those rights apply to such entities only to the extent required by the applicable law. Nothing in these Terms voluntarily extends all statutory Consumer rights to Business Customers.

The product description applicable to an order, the information displayed during checkout, our Shipping Policy, Return and Refund Policy, Privacy Policy and Legal Notice, as applicable, supplement these Terms.

In the event of a conflict, mandatory law prevails. Subject to mandatory law, specifically agreed individual terms relating to an order prevail over these general Terms.

3. PRODUCTS

Monautix sells sailing, watersports and related products, which may include technical clothing and footwear, sailing hardware and fittings, ropes and rigging products, instruments and timers, sails, boat equipment, accessories and other sporting equipment.

Products may originate from different manufacturers and brands, and product-specific instructions, warranties, safety information and conditions may therefore differ.

Monautix makes reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, compatibility information and other product information displayed in the online store are accurate.

Product colours and visual appearance may differ slightly from their on-screen representation due to display settings, lighting, materials or ordinary manufacturing variations.

Such minor visual differences do not constitute a lack of conformity where the Product otherwise conforms to the contract.

Nothing in this section restricts the Customer's statutory rights where a Product does not conform to its contractual description or applicable legal requirements.

4. TECHNICAL PRODUCTS, COMPATIBILITY AND COMPETITION USE

Many Products offered by Monautix are technical sailing products intended for particular boats, rigs, classes, installations, sailing conditions or uses.

Customers should check the relevant product description, specifications, dimensions, compatibility information and manufacturer instructions before ordering.

Where Monautix expressly states that a Product is compatible with a particular boat, class, model or specification, that statement forms part of the product information applicable to the purchase.

Where compatibility or configuration depends upon information supplied by the Customer, Monautix is entitled to rely on the accuracy and completeness of that information.

Products should be installed, rigged, maintained and used in accordance with manufacturer instructions, applicable safety information and appropriate technical practice.

Unless expressly stated as a contractual characteristic, statements concerning expected speed, racing performance, competitive advantage, sailing performance or similar matters do not constitute a guarantee of a particular sporting result.

Class rules, measurement requirements and competition eligibility may change. A Customer intending to use equipment in competition is responsible for checking the current rules applicable to the relevant event or class.

This does not restrict statutory rights if Monautix expressly represented a Product as complying with a particular class rule or approval applicable at the time of purchase.

5. CUSTOMER ACCOUNTS

A Customer account may provide access to previous or current orders and to functions made available through the online store, including applicable self-service return and cancellation functions.

Customers must provide accurate, current and complete information when using the online store.

Customers are responsible for keeping their account access secure and should notify Monautix without undue delay if they become aware of unauthorised access.

Creating a Customer account does not itself create any obligation to purchase.

6. ORDERING PROCESS AND CORRECTION OF INPUT ERRORS

The online ordering process generally consists of:

  1. selecting the Product and, where applicable, its size, colour, quantity or other variant;
  2. adding the Product to the shopping cart;
  3. reviewing the cart;
  4. providing or confirming contact, invoicing and delivery information;
  5. selecting an available delivery method;
  6. selecting an available payment method;
  7. reviewing the Products ordered, relevant costs and total amount payable; and
  8. submitting the order through the checkout function clearly indicating that submission creates a payment obligation.

Before submitting the order, the Customer is able to review the entered information and use the technical means provided by the online store to identify and correct input errors.

Customers should check the order and the information entered carefully before submission.

If an error is discovered after submission, the Customer should contact Monautix without delay. Monautix will make reasonable efforts to correct the information where the order has not progressed to a stage at which correction is no longer reasonably possible.

7. ORDER ACKNOWLEDGEMENT AND FORMATION OF THE CONTRACT

By submitting an order, the Customer makes a binding offer to purchase the Products included in the order at the price displayed at checkout.

After the order has been submitted, Monautix sends an automated electronic acknowledgement confirming that the order has been received.

This automated acknowledgement confirms receipt of the order only and does not constitute acceptance of the Customer's offer or conclusion of the sales contract.

The sales contract is concluded when Monautix accepts the Customer's order by sending a separate fulfilment confirmation, shipping confirmation or ready-for-pickup confirmation, as applicable.

Monautix may require successful payment authorisation before accepting an order.

Until the order has been accepted, Monautix may decline the Customer's offer on reasonable grounds, including lack of stock, a manifest pricing or product-information error, payment failure, inability to deliver the Product, or reasonable suspicion of fraud or misuse.

If payment has already been collected for an order that Monautix does not accept, Monautix will refund the amount collected without undue delay.

Monautix sends the electronic acknowledgement of receipt without undue delay. If the Customer does not receive such acknowledgement within 48 hours after submitting the order, the Customer is released from their offer to the extent provided by applicable law.

8. RIGHT TO DECLINE AN ORDER BEFORE ACCEPTANCE

Before the sales contract has been concluded, Monautix may decline an order on reasonable grounds, including:

  • lack of stock or inability to obtain the Product;
  • a manifest pricing, description or technical error;
  • unsuccessful payment or payment authorisation;
  • inability to deliver to the stated address;
  • reasonable suspicion of fraud, abuse or unlawful activity;
  • an order quantity clearly inconsistent with ordinary retail purchasing; or
  • another legitimate circumstance preventing lawful or reasonable fulfilment.

Once the contract has been concluded, Monautix may cancel, terminate or modify it only where permitted by the contract or applicable law.

9. OBVIOUS PRICING AND DESCRIPTION ERRORS

Monautix takes reasonable care when publishing Product information and prices.

If a price or other essential Product information contains an obvious and reasonably recognisable technical, typographical or data-entry error, Monautix may decline the order before acceptance and may invite the Customer to place a new order using the corrected information.

A manifest error does not entitle the Customer to require Monautix to supply a Product on terms which the Customer knew, or could reasonably have recognised, were erroneous.

Nothing in this section gives Monautix an unrestricted right to change the price or other essential terms of a contract that has already been validly concluded.

10. PRICES

Prices displayed to Consumers include VAT and other mandatory charges to the extent required by applicable law.

Delivery charges and any other additional costs payable by the Customer are displayed before the order is submitted.

The total amount shown at checkout immediately before submission is the amount payable for the order, subject only to matters permitted by applicable law, including correction of a manifest error in accordance with these Terms.

The currency available may depend on the market and destination selected in the online store.

Prices may be changed for future orders at any time. A later price change does not affect a contract already concluded.

Discounts, promotions, coupon codes and special offers may be subject to additional conditions communicated in connection with the relevant promotion.

11. PAYMENT AND INVOICING

The payment methods currently available for a particular order are displayed during checkout.

The Customer must provide accurate payment information and must be authorised to use the selected payment method.

Where the selected payment method requires authorisation or advance payment, Monautix may wait for successful payment authorisation before accepting or dispatching the order.

Invoices are issued in accordance with applicable Hungarian tax legislation and may be provided electronically where permitted.

12. PRODUCT AVAILABILITY

Stock information displayed in the online store reflects the information available to Monautix at the relevant time but does not constitute an unconditional guarantee of availability until the order has been accepted.

Stock discrepancies, simultaneous purchases or supplier-related shortages may occasionally occur.

If Monautix cannot supply an ordered Product, Monautix will inform the Customer as soon as reasonably practicable and, as appropriate, may offer:

  • cancellation of the unavailable Product;
  • an alternative Product, subject to the Customer's express agreement; or
  • cancellation of the relevant order.

Monautix will not substitute a materially different Product without the Customer's agreement.

Any amount due following cancellation will be refunded in accordance with applicable law.

13. DELIVERY

Delivery destinations, methods, current shipping charges and indicative delivery times are set out in our Shipping Policy and displayed as applicable during checkout.

For deliveries within Hungary, the usual estimated delivery period is generally 1–3 business days, subject to Product availability, the selected carrier and other relevant circumstances.

Delivery times to other EU Member States depend on the destination and carrier service.

Delivery periods described as estimates are not guaranteed fixed delivery dates unless Monautix expressly agrees otherwise.

Nothing in this section restricts any statutory remedy available to a Customer in the event of delayed performance.

14. TRANSFER OF RISK

In a Consumer contract, the risk of accidental loss of or damage to a Product passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Product.

Where the Consumer independently instructs a carrier that was not offered by Monautix, the special rules applicable to such independently arranged transport apply.

For Business Customers, unless otherwise agreed and to the extent permitted by applicable law, risk passes when the Products are handed over to the carrier for delivery.

15. FAILURE TO ACCEPT OR COLLECT DELIVERY

Simply refusing delivery, failing to collect a parcel from a parcel locker or collection point, or allowing a parcel to be returned to Monautix does not by itself constitute a valid exercise of the statutory right of withdrawal.

A Consumer wishing to withdraw from a contract must communicate that decision in accordance with applicable law and our Return and Refund Policy.

Where a shipment is returned because the Customer failed to accept or collect it without validly exercising a statutory right, Monautix reserves the right, to the extent permitted by law, to claim reasonable and documented costs or losses directly caused by the unsuccessful delivery.

Monautix does not impose an automatic penalty merely because a parcel was not collected.

16. STATUTORY RIGHT OF WITHDRAWAL

Consumers purchasing through the online store generally have a statutory 14-calendar-day right of withdrawal without giving a reason, subject to the conditions and statutory exceptions described in our Return and Refund Policy.

For goods, the withdrawal period generally begins when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the goods. Special rules apply where several goods or parts of an order are delivered separately.

A Consumer may exercise the right of withdrawal by:

  • making an unequivocal statement;
  • using the statutory model withdrawal form; or
  • using the electronic withdrawal function made available by Monautix.

The electronic withdrawal function is intended to remain clearly and easily accessible during the applicable withdrawal period. Where the function is used, Monautix provides the legally required electronic acknowledgement of the withdrawal.

The detailed rules concerning the withdrawal period, return of Products, return costs, reimbursement, diminished value and statutory exceptions are contained in our Return and Refund Policy.

17. CUSTOM, PERSONALISED AND CUSTOMER-SPECIFIC PRODUCTS

The statutory right of withdrawal does not apply where a statutory exception applies to goods that are not prefabricated and are manufactured on the basis of an individual choice or decision by the Consumer, or goods that are clearly personalised.

Depending on the particular Product and the way it is ordered, this may include, for example, an item individually manufactured, altered or prepared according to Customer-specific dimensions or instructions, or material cut to a Customer-specific length, where the statutory requirements for the exception are satisfied.

The fact that a standard Product is specially ordered by Monautix from a supplier because it is not normally held in stock does not by itself exclude the statutory right of withdrawal.

Where an individual Product is excluded from withdrawal because of its Customer-specific nature, the relevant information will be communicated before the Customer submits the order.

18. STATUTORY CONFORMITY RIGHTS / LIABILITY FOR DEFECTIVE PERFORMANCE

A Consumer has statutory rights against Monautix where goods supplied by Monautix are defective or otherwise fail to conform to the sales contract.

In the case of consumer sales of goods, the Consumer may in accordance with applicable law request repair or replacement, unless the selected remedy is impossible or would impose disproportionate costs compared with the alternative remedy, taking into account the circumstances prescribed by law.

The Consumer may be entitled to an appropriate price reduction or termination of the sales contract in the cases specified by applicable law, including circumstances in which repair or replacement has not been properly completed, the lack of conformity reappears, the defect is sufficiently serious, or it is clear that Monautix will not bring the Product into conformity within a reasonable period or without significant inconvenience to the Consumer.

The Consumer may not terminate the contract on the basis of an insignificant defect where applicable law so provides.

For Consumer sales of goods, statutory conformity claims are generally subject to a two-year limitation period from performance.

A defect communicated within two months of its discovery is regarded as having been communicated without delay.

Where a lack of conformity becomes apparent within one year after delivery, it is presumed, subject to the statutory exceptions, to have existed at the time of delivery unless Monautix proves otherwise.

These rights exist independently of any commercial manufacturer warranty.

19. PRODUCT WARRANTY

In addition to the statutory conformity rights exercisable against Monautix as seller, Hungarian law provides a separate statutory product-warranty regime in relation to defective movable goods.

A Consumer may exercise product-warranty rights against the producer/manufacturer or distributor as defined by applicable law.

Under a product-warranty claim, the Consumer may request repair or replacement of the defective Product.

For product-warranty purposes, a Product is defective if it did not meet the quality requirements applicable when it was placed on the market or did not possess the characteristics stated in the manufacturer's description.

A product-warranty claim may be exercised within two years from the date on which the Product was placed on the market by the manufacturer. Upon expiry of that period the statutory product-warranty right expires.

In a product-warranty claim, the Consumer bears the burden of proving that the relevant defect existed when the Product was placed on the market.

The producer/manufacturer or distributor may rely only on the statutory grounds for exemption from product-warranty liability.

Statutory product-warranty rights and statutory conformity rights are separate legal regimes. They may be pursued in accordance with the rules applicable to each regime, but the Customer is not entitled to double recovery for the same defect.

20. MANDATORY GUARANTEE FOR CERTAIN DURABLE CONSUMER GOODS

Certain new durable consumer goods belonging to categories specified by Hungarian law and having a sale price of at least HUF 10,000 are subject to a mandatory statutory guarantee.

The statutory product categories include, among other things, sports equipment. Certain sailing or watersports Products sold by Monautix may therefore fall within the mandatory guarantee regime.

Whether an individual Product is covered depends on its legal classification, characteristics and sale price and not merely on its brand or commercial description.

For Products covered by the mandatory guarantee regime, the current mandatory guarantee period is:

  • 2 years for a sale price of at least HUF 10,000 but not exceeding HUF 250,000;
  • 3 years for a sale price exceeding HUF 250,000.

The mandatory guarantee rules also apply to qualifying micro, small and medium-sized enterprises in the circumstances expressly specified by Hungarian law.

Where the mandatory guarantee applies, Monautix will provide the statutory guarantee information and, where required, the guarantee certificate in the form and language prescribed by Hungarian law.

For covered Products, the additional mandatory rules concerning repair, replacement and reimbursement apply.

In particular, subject to the exact statutory conditions applicable to the claim:

  • where Monautix establishes that the Product cannot be repaired, it must generally be replaced within the statutory period, unless the Consumer chooses otherwise;
  • where a Product fails again after three repairs, statutory replacement or reimbursement rules may apply;
  • where repair is not completed within 30 days after notification of the repair claim, statutory replacement or reimbursement rules may apply; and
  • for a defect preventing normal use where a replacement claim is made within three working days of purchase or installation, the special statutory replacement rules apply.

Any manufacturer's or distributor's voluntary commercial warranty is additional to and does not reduce mandatory statutory rights.

21. DAMAGE CAUSED AFTER DELIVERY, MISUSE AND NORMAL WEAR

Statutory conformity and guarantee rights apply to defects for which Monautix or another legally responsible party is liable under applicable law.

Monautix is not responsible for a defect, deterioration or damage to the extent it is shown to have been caused after delivery by circumstances for which Monautix is not legally responsible, including, where applicable:

  • inappropriate or unintended use;
  • failure to follow applicable manufacturer instructions or safety information;
  • incorrect installation, rigging or adjustment not attributable to Monautix;
  • use with incompatible components;
  • accident or external impact;
  • ordinary wear and tear;
  • improper storage, care or maintenance;
  • cutting, drilling, alteration or other modification after delivery; or
  • use outside the Product's intended or specified operating conditions.

This section does not alter any statutory burden-of-proof rule and does not permit Monautix to reject a valid claim merely by alleging misuse.

22. REPORTING DEFECTIVE OR NON-CONFORMING PRODUCTS

Claims concerning defective or non-conforming Products may be submitted to:

To enable efficient assessment, Monautix may reasonably request information such as:

  • the order number;
  • identification of the Product;
  • a description of the alleged defect; and
  • photographs or other information where these may reasonably assist in identifying the issue.

A request for such information does not create an unlawful additional condition for exercising a statutory right.

Where inspection of the Product is reasonably necessary, the Customer must make the Product available in accordance with applicable law.

Monautix will bear the costs for which it is legally responsible in connection with valid statutory conformity or guarantee remedies.

23. RETURNS, DIMINISHED VALUE AND REFUNDS

The rules applicable to change-of-mind returns and statutory withdrawal are set out in our Return and Refund Policy.

A Consumer exercising the statutory right of withdrawal may inspect and handle a Product to the extent reasonably necessary to establish its nature, characteristics and functioning.

The Consumer is responsible for any diminished value resulting from handling beyond what is necessary for that purpose.

In the case of technical sailing and watersports Products, depending on the circumstances, actual use on the water, sailing or racing in clothing, washing clothing, cutting or modifying equipment, rigging or installing equipment, or returning Products with salt, stains, sunscreen, odours, scratches or other signs of use may be relevant when determining whether diminished value has occurred.

Any assessment of diminished value will be made on the individual circumstances and in accordance with applicable law.

24. EXCHANGES

There is no separate statutory right requiring Monautix to exchange a correctly supplied, non-defective Product simply because the Customer would prefer another size, colour or Product.

Monautix may nevertheless agree to an exchange as a customer-service measure, subject to availability and the circumstances.

Alternatively, a Consumer may exercise the statutory right of withdrawal where applicable and place a separate order for the desired Product.

This section does not restrict statutory remedies relating to defective or incorrectly supplied Products.

25. COMPLAINTS

Monautix investigates oral complaints immediately where reasonably possible and takes appropriate steps to remedy them where the complaint is justified.

Where an oral complaint cannot be resolved immediately, or the Consumer disagrees with its handling, Monautix deals with the complaint in accordance with the record-keeping and response requirements imposed by applicable law.

A written Consumer complaint will be answered substantively and in a verifiable written form within 30 days of receipt, unless applicable law requires a shorter period.

Where Monautix rejects a complaint, the rejection will be reasoned and the Consumer will be provided with information concerning the authority or alternative dispute resolution body that may be contacted, as required by law.

Written complaints, records of oral complaints where required, and copies of substantive responses are retained for three years.

26. ALTERNATIVE DISPUTE RESOLUTION

Monautix aims to resolve disputes directly with Customers wherever reasonably possible.

A Consumer should first contact Monautix in an attempt to resolve the dispute.

Consumers may subsequently initiate proceedings before the competent Hungarian conciliation body (békéltető testület) in accordance with applicable law.

Its territorial jurisdiction includes Fejér, Komárom-Esztergom and Veszprém vármegye.

This information does not restrict a Consumer from applying to another conciliation body where applicable law allows the Consumer to choose another competent body.

Monautix complies with its statutory cooperation obligations in conciliation proceedings.

27. RELATIONSHIP WITH SHOPIFY

The Monautix online store uses technology and hosting services provided through the Shopify platform.

The seller of Products purchased through the Monautix online store is Monautix Kft., not Shopify.

The sales contract is concluded between the Customer and Monautix.

Shopify and other technical providers may independently provide technical functionality or process personal information in accordance with their applicable terms and privacy arrangements.

Nothing in this section excludes any statutory liability or right which cannot lawfully be excluded.

28. THIRD-PARTY SERVICES AND LINKS

The online store may include links to or integrations with third-party providers, including payment, delivery, social-media or other technical services.

Where a Customer independently enters into a separate transaction with a third party, that transaction may be governed by the third party's own terms.

Monautix is not responsible merely by virtue of providing a link for the independent content or operation of a third-party website.

This does not restrict Monautix's responsibility for persons used by Monautix to perform obligations for which Monautix remains legally responsible towards the Customer.

29. INTELLECTUAL PROPERTY

Texts, photographs, graphics, design elements and other materials appearing in the online store may be owned by Monautix or used with the permission of manufacturers, suppliers or other rights holders.

Nothing in the online store transfers intellectual property rights to the Customer.

Content protected by intellectual property law may not be commercially reproduced, republished, distributed, modified or exploited without permission from the relevant rights holder, except where such use is permitted by applicable law.

Names, logos, trademarks, Product names and other protected identifiers belonging to manufacturers or other third parties remain the property of their respective owners.

30. ACCEPTABLE USE OF THE ONLINE STORE

The online store may be used only for lawful purposes.

Users must not knowingly:

  • interfere with the operation or security of the store;
  • introduce viruses or other malicious software;
  • attempt unauthorised access;
  • use the store for fraudulent or unlawful purposes;
  • infringe intellectual property, privacy or other rights; or
  • use automated systems in a manner that materially disrupts or overloads the service or circumvents technical security restrictions.

Monautix may take reasonable technical measures to protect the online store, its Customers and third parties and may restrict access where reasonably necessary, subject to applicable law.

31. LIABILITY

Consumers

Nothing in these Terms excludes or limits Monautix's liability or obligations towards Consumers where such exclusion or limitation is prohibited by mandatory law.

In particular, nothing in these Terms limits statutory rights relating to conformity of goods, product safety, mandatory guarantees, personal injury or any other liability that cannot lawfully be excluded or restricted.

Monautix is not responsible for loss, damage or non-performance to the extent that it results from circumstances for which Monautix is not legally responsible.

Business Customers

To the maximum extent permitted by applicable law, Monautix shall not be liable to a Business Customer for indirect or consequential economic losses, including loss of profit, loss of anticipated savings or loss of business opportunity, unless such liability cannot legally be excluded or limited.

To the maximum extent permitted by law, Monautix's aggregate contractual liability to a Business Customer arising from an individual order shall not exceed the amount paid for the Product giving rise to the relevant claim.

Nothing in this section excludes or limits liability where exclusion or limitation is prohibited by law.

32. EVENTS OUTSIDE REASONABLE CONTROL

Monautix is not responsible for delay or failure in performance to the extent caused by circumstances outside its reasonable control and to the extent permitted by applicable law.

Such circumstances may include extraordinary transport disruption, natural disasters, government measures, major infrastructure or telecommunications failures, industrial action affecting third parties or comparable extraordinary events.

Where such circumstances materially affect an order, Monautix will take reasonable steps to inform the Customer and to resume performance as soon as reasonably possible.

This section does not remove any mandatory statutory remedy available to the Customer if performance is delayed or becomes impossible.

33. PRIVACY AND COOKIES

Personal data is processed in accordance with the Monautix Privacy Policy.

Information concerning cookies and similar technologies is provided through the relevant cookie information and consent-management mechanisms.

Information regarding the involvement of Shopify, payment providers, carriers, analytics providers or marketing services in personal-data processing is provided in the Privacy Policy where required.

34. GOVERNING LAW AND JURISDICTION

These Terms and contracts concluded through the Monautix online store are governed by Hungarian law, subject to mandatory European Union conflict-of-law rules.

Where a Consumer is habitually resident in another country and applicable law provides mandatory Consumer protections from which the parties may not derogate by agreement, the choice of Hungarian law does not deprive the Consumer of those protections.

Nothing in these Terms restricts a Consumer's right to bring proceedings before any court having jurisdiction under mandatory applicable law.

For Business Customers, disputes are subject to the jurisdiction determined by Hungarian procedural law and any valid individual jurisdiction agreement between the parties.

35. AMENDMENTS TO THESE TERMS

Monautix may amend these Terms for future use, including in response to changes in legislation, business operations, delivery or payment arrangements, technical systems or other relevant circumstances.

The version in force at the time an order is submitted applies to that order, unless mandatory law requires otherwise.

An amendment published after a contract has been concluded does not retrospectively change that contract without a lawful basis or the agreement of the parties.

The current version of these Terms is made available through the online store.

36. CONTRACT LANGUAGE, FORM, STORAGE AND CODE OF CONDUCT

Contracts through the Monautix online store may currently be concluded in Hungarian and English.

For the purposes of the statutory information requirements governing electronic contracting, a contract concluded through the standard Monautix online checkout is not considered a separately executed written contract.

The contract is not individually filed by Monautix as a separately signed written instrument.

Order details, confirmations, invoices and other transaction records are nevertheless stored electronically for the periods required by applicable accounting, tax, consumer-protection and data-protection rules.

Where Customer-account functionality is available, the Customer may access certain order information through the account. Customers may also contact Monautix regarding previous orders, subject to applicable retention periods.

The Customer may save or print these Terms before placing an order.

Monautix provides the legally required contractual and pre-contractual information on a durable medium where required by applicable law.

Unless expressly stated otherwise in the online store, Monautix has not voluntarily undertaken to be bound by a specific commercial code of conduct applicable to the operation of this online store.

37. CONTRACT CONFIRMATION AND PROVISION OF CONTRACTUAL INFORMATION ON A DURABLE MEDIUM

Following conclusion of a distance contract, Monautix provides the Consumer with confirmation of the contract and the contractual information required by applicable law on a durable medium, within the applicable statutory period and, in the case of a sales contract for goods, no later than delivery where required by law.

For this purpose, the contractual information applicable to the order, including the applicable Terms of Service and Return and Refund Policy, may be provided to the Consumer by email and/or as PDF attachments in a form that allows the Consumer to store, reproduce and access the information unchanged for an appropriate period.

Where the relevant contractual information has already been provided to the Consumer on a durable medium before conclusion of the contract, Monautix is not required to provide the same information again except where applicable law requires otherwise.

The version of these Terms and the other contractual information applicable to an order is the version in force when the relevant order is placed, subject to mandatory law.

The order-specific confirmation provided by Monautix may also contain or reproduce information such as the Products ordered, quantities, prices, delivery method, delivery charges, payment method and other details of the individual transaction.

Where PDF attachments are used, Monautix may generate them automatically from the policies in force at the time of the order through the technical functionality of the online store.

Nothing in this Section limits any mandatory requirement concerning the timing, content or form of contractual confirmation under applicable Hungarian or European Union law.

38. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

Where a mandatory legal provision applies in place of an invalid contractual term, the mandatory provision applies.

39. NO WAIVER

Failure by Monautix to exercise a contractual right in a particular case does not constitute a general waiver of that right.

This provision does not affect statutory limitation periods or mandatory rules governing the exercise of rights.
