RETURN AND REFUND POLICY

This Return and Refund Policy applies to purchases made through the Monautix online store operated by Monautix Kft.

1. Scope of this Policy

The statutory 14-day right of withdrawal described below applies to consumers, meaning natural persons acting for purposes outside their trade, business, craft or profession.

Orders placed by companies, sole traders or other persons acting for business or professional purposes are not automatically covered by the statutory consumer right of withdrawal unless mandatory law provides otherwise or Monautix expressly agrees to accept the return.

Unless expressly agreed otherwise by Monautix, this Policy does not create any additional voluntary return right beyond the statutory rights described below.

2. Statutory 14-Day Right of Withdrawal

If you are a consumer purchasing goods through our online store, you have the right to withdraw from the contract within 14 calendar days without giving any reason.

For the purchase of goods, the withdrawal period generally expires 14 days after the day on which you, or a third party designated by you other than the carrier, takes physical possession of the goods.

If several goods ordered in one order are delivered separately, the 14-day period begins when you receive the last item.

If a product is delivered in several consignments or parts, the period begins when you receive the last consignment or part.

You may also exercise your right of withdrawal after placing your order and before the goods are delivered.

3. How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform Monautix of your decision to withdraw by means of a clear and unequivocal statement before the withdrawal period expires.

Online: using the electronic withdrawal / return or cancellation function provided through the Monautix online store, customer account or order page;

Access your customer account here to submit a return or cancellation request.

You may also use the Model Withdrawal Form at the end of this Policy, although use of the form is not mandatory.

Where the electronic withdrawal function is used, Monautix will provide electronic acknowledgement of the withdrawal without undue delay.

The withdrawal deadline is met if you send your withdrawal statement before the 14-day period expires.

Refusing or failing to collect a delivery

Simply refusing delivery of a parcel, failing to collect a parcel from a parcel point or locker, or allowing a parcel to be returned to Monautix does not in itself constitute a valid exercise of the statutory right of withdrawal.

If you wish to withdraw from your purchase, you must communicate that decision to Monautix in one of the ways described above.

4. Returning the Goods

After communicating your withdrawal, you must return or hand over the goods to Monautix without undue delay and in any event no later than 14 calendar days from the date on which you communicated your withdrawal.

The deadline is met if you dispatch the goods before the 14-day return period expires.

Please include your order number or sufficient information for us to identify the order.

Prior authorisation by Monautix is not a condition of exercising the statutory right of withdrawal, although contacting us before sending the goods is strongly recommended so that we can identify and process your return efficiently.

Please do not send change-of-mind returns cash on delivery or with postage payable by Monautix.

5. Return Shipping Costs

If you exercise your statutory right of withdrawal because you have changed your mind, you are responsible for the direct cost of returning the goods to Monautix, unless Monautix expressly agrees otherwise.

The customer is responsible for choosing an appropriate return method and for packaging the goods appropriately for transport.

We strongly recommend using a trackable shipping method and retaining proof of dispatch until the return has been fully resolved.

Different rules may apply where goods are returned because they are defective, damaged, incorrectly supplied or otherwise do not conform to the contract. Please see Section 10 below.

6. Inspection of Products and Diminished Value

The statutory right of withdrawal allows you to inspect and handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in a manner comparable to the inspection that would normally be possible in a physical shop.

You do not lose your right of withdrawal merely because:

  • you opened the external packaging;

  • you reasonably inspected the product; or

  • you tried on an item of clothing to determine its size and fit.

However, you are responsible for any diminished value of the goods resulting from handling or use beyond what is necessary to establish their nature, characteristics and functioning.

Monautix therefore reserves the right to assess returned goods for any diminished value caused by excessive handling or use and to assert a claim for such diminished value in accordance with applicable law.

Depending on the product and the circumstances, examples of handling that may go beyond what is reasonably necessary for inspection can include:

  • wearing technical clothing or footwear during sailing, training, racing or other actual use;

  • washing or cleaning clothing before returning it;

  • returning clothing with visible dirt, salt, sunscreen, stains, odours or other signs of use;

  • using equipment on the water;

  • installing, rigging, drilling, cutting, trimming or permanently modifying equipment;

  • cutting rope, line, elastic or other products supplied in a length;

  • removing or damaging components, accessories or documentation;

  • causing scratches, wear, deformation or other deterioration beyond reasonable inspection.

Whether diminished value has occurred will be assessed case by case, having regard to the nature of the particular product and the extent of handling reasonably necessary to inspect it.

We therefore ask customers, where reasonably possible, to return products:

  • clean and dry;

  • complete;

  • together with all accessories and documentation;

  • with product labels and tags still attached where they have not needed to be removed for reasonable inspection; and

  • in the original packaging where reasonably possible.

Original packaging, intact tags or an entirely unused condition are not absolute prerequisites for exercising the statutory right of withdrawal. However, their absence or the condition of the returned product may be relevant when determining whether the product has suffered diminished value.

7. Refunds Following Withdrawal

If you validly withdraw from the contract, Monautix will reimburse the amounts due to you without undue delay and, subject to the statutory right to withhold reimbursement described below, no later than 14 calendar days from the date on which Monautix is informed of your decision to withdraw.

Monautix's right to withhold reimbursement

For sales of goods, Monautix is entitled to withhold reimbursement until the earlier of:

  1. the date on which Monautix receives the returned goods; or

  2. the date on which you provide satisfactory evidence that the goods have been sent back.

Monautix will inspect returned goods as soon as reasonably practicable after receipt in order to establish their condition and whether any diminished value has resulted from handling beyond what was reasonably necessary.

Where legally permissible, any claim for diminished value may be taken into account when determining the final amount payable to the customer.

If reimbursement has already been made because the customer provided evidence of dispatch before Monautix received and inspected the goods, that reimbursement does not waive any claim Monautix may have under applicable law for diminished value subsequently identified upon inspection of the returned goods.

8. Original Delivery Charges

If you withdraw from the entire order, Monautix will reimburse the original delivery charge up to the cost of the least expensive standard delivery method offered by Monautix for that order, where required by law.

If you chose a more expensive delivery option than the least expensive standard delivery method offered by Monautix, the additional cost resulting from that choice will not be reimbursed.

If you withdraw only in respect of part of an order, the original delivery charge will be reimbursed only to the extent required by applicable law. In particular, no delivery cost will be refunded where the same delivery cost would have been payable for the products that you retain.

The direct cost of sending withdrawn goods back to Monautix remains the responsibility of the customer, as described in Section 5.

9. Method of Refund

Refunds will be made using the same payment method used for the original transaction, unless you expressly agree to another method.

Monautix will not charge you a fee for processing the statutory reimbursement.

After Monautix has initiated the reimbursement, your bank, card issuer or payment service provider may require additional processing time before the refund appears in your account. Such processing time is outside Monautix's control.

10. Defective, Damaged or Incorrect Goods

The statutory right of withdrawal is separate from your legal rights relating to goods that are defective, damaged, incorrectly supplied or otherwise do not conform to the contract.

If you believe that a product is defective, damaged or incorrect, please contact us as soon as reasonably possible at:

Please provide:

  • your order number;

  • a description of the issue; and

  • photographs where these may help us identify the problem.

Providing photographs may enable us to resolve the matter more quickly but does not replace or restrict any statutory rights available to you.

Where a product is defective or does not conform to the contract, the cost and method of return will be dealt with in accordance with the applicable statutory warranty, conformity and consumer protection rules.

Failure to report a defect immediately after delivery does not in itself deprive a consumer of statutory rights.

Nothing in this Policy limits your rights relating to defective or non-conforming goods under mandatory Hungarian or European Union law.

11. Products Excluded from the Statutory Right of Withdrawal

The right of withdrawal does not apply where an exception provided by applicable law applies.

For products that may be offered by Monautix, relevant exceptions may include in particular:

Custom-made or personalised goods

The right of withdrawal does not apply to goods that are not prefabricated and have been manufactured on the basis of the consumer's individual instructions or specific request, or to goods that are clearly personalised for the consumer.

Sealed goods for health protection or hygiene reasons

The right of withdrawal may not apply to sealed goods that are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery, provided that the statutory requirements for this exception are satisfied.

The mere opening of ordinary product packaging does not automatically bring a product within this exception.

Any statutory exception will be interpreted in accordance with applicable consumer law.

12. Sale, Discounted and Outlet Products

A product is not excluded from the statutory right of withdrawal merely because it was purchased at a reduced, promotional, sale or outlet price.

The statutory withdrawal rules therefore also apply to discounted goods unless a separate statutory exception applies.

This does not affect any reduction in price that was expressly agreed because of a specific defect or characteristic of the goods, or any other consequences permitted by applicable law.

13. Exchanges

There is no separate statutory right requiring Monautix to exchange a correctly supplied, non-defective product for another size, colour or product.

Where possible and subject to availability, Monautix may agree to arrange an exchange as a customer service.

Alternatively, you may exercise your statutory right of withdrawal in accordance with this Policy and place a new order for the required item.

Any voluntary exchange arrangement does not restrict your statutory right of withdrawal.

14. Uncollected or Refused Parcels

Failure to collect a parcel, refusal of delivery or failure to respond to a carrier's collection notification does not automatically cancel the order and does not, by itself, constitute a statutory withdrawal.

Where an order is returned to Monautix because the customer failed to accept or collect the delivery without validly exercising the right of withdrawal, Monautix reserves the right, to the extent permitted by applicable law, to claim reasonable costs or losses directly resulting from the failed delivery.

This does not prevent the consumer from validly exercising the statutory right of withdrawal in accordance with this Policy.
